Rules

No purchase is necessary to enter the Contest. A purchase does not increase the chances of winning. We will never ask you for personal banking information or to send us money. We will only ask for your home address to send you the prize.

1. Eligibility: The “Holiday Contest” (“Contest”) is only open to people who have entered the Contest by scanning the QR code in-store, on Facebook, on Instagram and via the newsletter and who are 18 years of age or older on the date of entry. The Contest is open only to legal residents of Canada and is void where prohibited by law. Employees, independent contractors, interns, officers, directors and agents of Crosby Foods (“Crosby Foods”) are not eligible to participate in the Contest from Crosby Foods (the “Sponsor”), their affiliates, subsidiaries, advertising and promotional agencies, suppliers and their immediate family and/or living in the same household as each of them are not eligible to participate in the Contest. The Sweepstakes is subject to all applicable federal, provincial and local laws and regulations. Void where prohibited.

2. Acceptance of Rules: By participating in the Contest, the entrant (“You”) agrees to abide by these Rules and the decisions of the Sponsor, and you represent and warrant that you meet the eligibility requirements.

3. Entry Period: The Contest begins on November 1st 2024 at 5:00 a.m. ATL and ends on December 30th, 2024 at 11:59 p.m. ATL (the “Entry Period”) for Federated Co-op and January 1st, 2025 for Sobey’s. Entries submitted before or after the entry period will not be eligible.

4. How to Enter: Scan the QR Code on the Point of Sale Display to enter and follow the steps requested on the website. Entry must meet all requirements of the Contest, as specified, to be eligible to win the prize. Entries that are incomplete or do not comply with the rules or specifications of the competition may be disqualified. You must provide the requested information. You may not enter more than stated by using multiple email addresses, identities, or devices to attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the Contest Rules, your submission may be disqualified.

5. Prizes:

No substitutions or other prizes will be allowed, except at our discretion. The prize is non-transferable. Substitution of the prize or transfer/assignment of the prize to third parties or request of the cash equivalent of the prize by the winner is not permitted. Acceptance of the prize constitutes permission for Sponsor to use the winner’s name, likeness, and entry for publicity and exchange purposes without further compensation, unless prohibited by law.

6. Odds of Winning: The odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification: The winner will be selected by random drawing under the supervision of the Sponsor. Winners will be notified within 24 hours of winner selection. Sponsor shall not be responsible for a winner’s inability to receive notifications due to spam, junk mail, or other security settings or for a winner’s provision of incorrect or otherwise non-functional contact information. If the winner cannot be contacted, is not eligible, fails to claim the prize within 7 days of the notification of awarding is sent, the prize may be forfeited and an alternate winner selected. Any violation of these Official Rules by the winner, in the sole discretion of the Sponsor, will result in the disqualification of the winner as a winner, and all privileges as a winner will immediately terminate.

8. Rights Granted by Entrant: By entering such content (e.g., photo, video, text, etc.), you understand and agree that Sponsor and anyone acting on behalf of Sponsor or its respective licensees, successors and assigns, shall have the right, where permitted by law, to print, publish, broadcast, to distribute and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, likeness, likeness, voice. , likeness, image, statements about the contest, and biographical information for current, publicity, informational, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this content, you represent and warrant that your entry is an original work of authorship and does not infringe the proprietary or intellectual property rights of any third party. If your entry infringes the intellectual property rights of others, you will be disqualified in Sponsor’s sole discretion. If the content of your entry infringes any proprietary or intellectual property rights of a third party, you must, at your sole expense, defend or settle such claims. You shall indemnify, defend, and hold Crosby Foods harmless from and against any suit, proceeding, claim, liability, loss, damage, cost, or expense that Crosby Foods may incur, suffer, or be required to pay as a result of such alleged infringement or violation of the right of a third party.

9. Terms and Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes in the event of a virus, bug, unauthorized human intervention, fraud or any other cause beyond Sponsor’s control that corrupts or affects the administration, security, fairness or proper conduct of the Sweepstakes. In such cases, Sponsor may select one or more winners from among the eligible entries received before and/or after the action taken by Sponsor, if any. The Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with or attempts to tamper with the entry process or the operation of the Contest or the Website or who violates these Terms and Conditions. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer beyond what is permitted by the Contest Rules; or the use of robots, macros, scripts, or other technical means to enter. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.

10. Limitation of Liability: By participating in the Contest, you agree to release and hold harmless Crosby Foods and its subsidiaries, affiliates, advertising and promotional agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any and all liability, illness, injury, death, loss, dispute, claim or damage which may arise, directly or indirectly, whether caused by negligence or not, (i) such entrant’s participation in the Contest and/or acceptance, possession, use or misuse of any prize or any portion thereof; (ii) unauthorized human intervention in any part of the Contest; (iii) electronic or human error in the administration of the Contest or the processing of entries; (iv) technical errors of any kind, including, but not limited to, malfunction of any computer, cable, network, hardware or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmission, telephone or Internet service; (vi) printing errors; (vii) lost, late, postage-due, misdirected, or undeliverable mail.

11. Disputes: This Contest shall be governed by the laws of Canada, without regard to conflict of law doctrines. By participating in this Contest, you agree that all disputes that cannot be resolved between the parties and causes of action arising out of or related to this Contest shall be resolved individually, without resort to any form of class action, exclusively in a court located in Canada having jurisdiction. Further, in any such dispute, you will not be entitled to recover damages in any way and you hereby waive any and all rights to punitive, incidental or consequential damages, including reasonable attorneys’ fees, other than actual expenses (i.e., costs associated with participating in the Contest). You further waive any right to have the damage multiplied or increased.

12. The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn, or any other social network used to share the sweepstakes. You understand that you are providing your information to the Contest Owner and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn, or any other social network.

13. Acceptance of Rules: By participating in the Contest, you have expressly reviewed, accepted and agreed to all of the Official Rules, Terms and Conditions. You also expressly accept to receive emails on offers, recipes and etc to your inbox with entering this contest.
